Orange Beach public records request to start from scratch

A judge dismissed a lawsuit against the city of Orange Beach, but the plaintiff was given 30 days to amend and refile the suit.

Orange Beach, Alabama STOCK

A judge on Tuesday dismissed a lawsuit against the city of Orange Beach but is giving plaintiff C.C. Dixon-Moreno 30 days to amend and refile the suit.

Dixon-Moreno has made it clear on social media that she intends to follow through, stating the original complaint filed in Baldwin County Circuit Court was hastily made in an attempt to access records before the election.

Dixon-Moreno is a practicing attorney in Mississippi with a focus in real estate and is still awaiting reciprocal approval to practice law in Alabama. But Dixon-Moreno filed the suit pro se as an Orange Beach resident, allowing her to bypass the need for a license.

As the suit is refiled, Dixon-Moreno will be represented by attorney Dennis Green out of Pensacola and will no longer be making filings pro se.

All the back and forth between Dixon-Moreno and Orange Beach attorneys is now moot, including Dixon-Moreno’s call for sanctions against the defendants.

Attorneys for Orange Beach argued that Dixon-Moreno’s pleadings are nothing more than “fuel for her social media reality show,” while Dixon-Moreno has said she has a free speech right to post about the case on social media and that there is no monetization of the posts.
